Project Revived to Sanction Deputies for Corruption

A previously discarded proposal aimed at establishing sanctions for corrupt legislators has been revived in the Asamblea Legislativa. Initially introduced by ex-deputy José María Villalta, the proposal was rejected by 28 deputies on July 6, but has since been reintroduced by the Frente Amplio party.

This bill, if passed, would entail significant consequences for deputies found guilty of integrity breaches, potentially resulting in the loss of their legislative seat.

It’s noteworthy that as far back as 2010, the Constitutional Chamber determined the need for a legislative responsibility framework for deputies. Additionally, a 2018 constitutional amendment allowed for the revocation of a deputy’s credentials, but without a formal law, there’s no procedure in place.

In the proposed system, the Public Ethics Ombudsman would conduct investigations and provide recommendations, but the ultimate decision would lie with the Legislative Assembly. If any integrity breaches are deemed severe, the Tribunal Supremo de Elecciones would revoke the credentials of the sanctioned deputies.

The bill also outlines the responsibilities of both the Comptroller’s Office and the Ombudsman in reporting and overseeing such breaches.
